STOORY Terms and Conditions of Use and Sale
These Terms govern the access to and use of the STOORY platform, available through www.stoory.it, as well as the purchase and use of the digital services offered.
1. Service Provider
STOORY is managed by Winnow Communication — VAT no. 05004790266 — email: info@winnowcommunication.com.
2. Acceptance
By using STOORY or purchasing a service, the user declares to have read and accepted these Terms and any specific conditions displayed during the purchase process.
The Privacy Policy, Cookie Policy, Creator Terms, and other specific conditions referenced by the platform constitute complementary documents.
3. What is STOORY
STOORY is a digital publishing platform through which it is possible, depending on the available features, to:
- discover stories and series;
- purchase access to digital content;
- read works in your library;
- start from an idea to create a story;
- upload your own draft or manuscript;
- use editorial development tools;
- publish certain works;
- participate in Creator programmes;
- monetise works according to the applicable conditions.
4. Account
Certain features require an account. The user is responsible for:
- the accuracy of the information provided;
- the security of their access;
- the activities carried out through their account;
- keeping their data updated.
It is not permitted to transfer, sell, or improperly share the account. STOORY may adopt security systems such as OTP, session limitations, and authorised device limits.
5. Age
Activities involving:
- entering into economic contracts;
- commercial publication;
- monetisation;
- earning compensation;
- using Stripe Connect;
- participating in the Creator programme
are reserved for adult users who are legally capable of entering into contracts.
Content intended for children may be consumed under the responsibility of the parent or the person exercising parental responsibility, according to the available features.
6. Catalogue Stories
STOORY may make stories, digital books, and editorial series available. The purchase of digital content grants the user the right to use it in the manner indicated at the time of purchase.
Unless expressly stated otherwise, the purchase does not transfer:
- copyright;
- editorial rights;
- reproduction rights;
- distribution rights;
- commercial exploitation rights.
7. Library and Online Reading
Purchased works can be made available through the STOORY digital library. Access may be subject to technical protection measures, including:
- authentication;
- temporary sessions;
- email verification;
- device limitations;
- watermarks;
- tools to prevent copying and unauthorised access.
The user may not circumvent such measures.
8. Creating a Story
STOORY allows the user to start, depending on the selected service, from:
- an idea;
- a few pointers;
- a theme;
- characters;
- a plot;
- a text;
- a draft;
- a manuscript;
- an attached document.
STOORY uses technological tools, artificial intelligence systems, and editorial processes to develop the project. The exact characteristics of the service depend on the product or plan selected.
8-bis. Credits, Drafts, and Deletion
A Creation credit is consumed the moment the system generates the requested draft or preview (title, synopsis, and cover proposals), regardless of the user's subsequent decision to proceed or not.
If the user deletes the draft, the already used Creation credit is not returned, re-credited, or refunded. The same applies to the free trial: once the preview is generated, the right to the trial is considered used and does not become available again after deletion.
The same rule applies to the Editing service: the analysis (Editing credit or first free analysis) is considered used when the editorial report is generated. If the user decides not to proceed with the editing and the request remains in draft, deleting the draft does not result in the return of the used analysis nor any refund.
Drafts remain available in the Creator Area and can be resumed at any time without consuming a further credit.
9. Drafts and Attached Files
When the user uploads their own draft or document, such material is used as a basis to provide the requested service. STOORY may:
- analyse the document;
- organise the narrative structure;
- expand scenes;
- improve the prose;
- correct inconsistencies;
- develop characters;
- create new coherent passages;
- perform editorial checks.
STOORY may adopt technical procedures aimed at maintaining narrative consistency with the original material.
10. Artificial Intelligence and Editorial Process
STOORY uses artificial intelligence systems to support certain activities. These may concern, for example:
- narrative planning;
- writing;
- revision;
- continuity checks;
- translation;
- covers;
- images;
- audio;
- video;
- synopses;
- metadata.
Content may subsequently be subjected to automated and/or editorial checks. Information on transparency in the use of artificial intelligence is available on the /en/trasparenza-ai page.
STOORY may also apply technical or machine-readable markings to content when provided for or appropriate under applicable regulations.
11. Editorial Author Identities
STOORY may use editorial author identities created to organise and characterise the catalogue. These identities have an editorial and narrative function and do not necessarily correspond to real natural persons.
Their respective portraits may also be created or processed through digital or artificial intelligence tools. STOORY makes specific information available through the AI Transparency page.
12. User-Provided Content
The user retains the rights they possess over the original materials provided by them. By uploading content, they grant STOORY, for the necessary duration, the right to:
- store it;
- process it;
- technically modify it;
- transmit it to necessary providers;
- use it to generate the requested product;
- perform editorial and security checks.
This authorisation is limited to the purposes necessary for providing the service and any further authorisations specifically accepted by the user.
13. User Warranties on Uploaded Materials
The user declares to have the right to use the uploaded content. It is forbidden to upload material that is:
- illegally copied from third-party works;
- in violation of copyright;
- in violation of trademarks or other rights;
- containing personal data of third parties used illegally;
- intended to fraudulently impersonate real people;
- unlawful under applicable regulations.
14. Originality
STOORY may use control systems aimed at reducing the risk of:
- duplications;
- excessive similarities;
- inconsistencies;
- unwanted reproduction of existing works.
These tools improve editorial control, but no automated system can guarantee the absolute absence of any similarity to existing works, ideas, or narrative elements.
15. Covers and Visual Materials
STOORY may generate:
- covers;
- artwork;
- images;
- editorial portraits;
- promotional materials.
When provided for by the editorial system, STOORY may adopt controls aimed at visually differentiating the images used in the catalogue.
16. Publication
Some services may allow for the publication of a work on the platform.
The mere creation of a story does not automatically grant the right to publish it commercially if the purchased product does not include such a feature. Economic terms and rights relating to publication are indicated in the applicable service or plan.
17. Creators and Monetisation
Creator features may allow eligible users to publish works and receive compensation on sales. Conditions relating to:
- percentages;
- non-exclusive licence;
- rights;
- compensation;
- accrual;
- payouts;
- thresholds;
- Stripe Connect;
- termination of the relationship
are governed by the STOORY Creator Terms and the chosen plan. In case of conflict, the Creator Terms prevail for matters specifically regulated therein.
18. No Guarantee of Earnings
The possibility to publish or monetise a work does not represent a guarantee of sales or earnings. STOORY does not guarantee:
- a minimum number of sales;
- a specific turnover;
- the commercial success of the work;
- a specific level of visibility;
- positioning on search engines or external platforms.
Any earnings depend on the sales actually generated and the applicable economic conditions.
19. Prices
Prices are indicated before purchase. Before the conclusion of the order, the following are displayed:
- product or service;
- price;
- any applicable taxes;
- essential characteristics;
- any specific conditions.
STOORY may modify the prices of future services without retroactively changing purchases already concluded.
20. Payments
Payments may be processed via Stripe or other authorised providers. The user is responsible for the accuracy of the information provided for payment.
STOORY may refuse or suspend an order in case of:
- unauthorised payment;
- suspected fraud;
- incorrect amount;
- technical error;
- violation of these Terms.
21. Digital Content and Right of Withdrawal
For digital content not supplied on a tangible medium, European and Italian law provide specific rules on the right of withdrawal.
When the user requests that the supply of digital content begins immediately, before the expiry of the ordinary withdrawal period, STOORY acquires, where necessary:
- express consent to the immediate start of the service;
- a declaration whereby the user acknowledges losing the right of withdrawal once the supply has begun under the conditions provided by law;
- the relevant contractual confirmation.
STOORY displays such acceptance clearly in the checkout process when applicable. Consumer rights relating to the conformity of the digital content or service remain unaffected.
STOORY works are also digital content custom-made based on the idea, characters, and title indicated by the user: withdrawal is therefore also excluded pursuant to Article 59 of the Consumer Code relating to clearly personalised goods and content. In case of withdrawal, the user shall refrain from using the digital work and from making it available to third parties (Article 57, paragraph 2-bis).
For contracts concluded through the site, the user may exercise the right of withdrawal, where applicable, also through the online withdrawal function available on the /en/recesso page (Article 54-bis of the Consumer Code): after confirmation, STOORY sends an acknowledgement of receipt on a durable medium with the content, date, and time of transmission.
22. Problems with Content or Service
If purchased content is not available or presents a technical problem, the user can contact info@winnowcommunication.com.
STOORY will evaluate the request in compliance with the applicable regulations on digital content and services. The provisions of these Terms do not limit the mandatory rights recognised for consumers.
23. Prohibited Uses
It is forbidden to use STOORY for:
- illegal activities;
- fraud;
- copyright violations;
- unauthorised distribution of content;
- unauthorised access to systems;
- unauthorised scraping;
- circumvention of security measures;
- sending unsolicited messages (spam);
- creating content that violates the Content Policy.
STOORY may suspend or terminate the account of users who violate these prohibitions.
24. Modifications to the Terms
STOORY may update these Terms to reflect changes in the service, the market, or the regulations. The updated version is published on the site and the date of the last update is indicated. Continued use after the modification constitutes acceptance of the new Terms.
25. Applicable Law and Jurisdiction
These Terms are governed by Italian law. For consumers, the mandatory protections provided by the law of their country of residence remain unaffected. Any disputes will be subject to the jurisdiction provided by the regulations for consumers.
